A Review Study on Medical Malpractice and Physician's Duties

Abstract
Nowadays, medical dispute has been increased every year and there are many problems to determine medical malpractice, and there have been large gaps between judicial requirement to medical practice and present status of medical practice. Therefore, reviewed physician's duties such as informed consent, to clarify the therapeutic agent and proceduce performed, and medical error and concept of inevitability. Then to decrease the gaps of both, discussed scope of consent, effect of consent, prima facie, res ipsa loquiturs judgement and consent in medicine, and judicial effect of consent letter of surgical operation.
